KUALA LUMPUR, Dec 16 (Bernama) -- The Magistrate Court here acquitted and discharged chief activist of Malaysian Muslim Consumer Association (PPIM) Datuk Nadzim Johan and another member of the association of a charge of causing hurt to Frenchman last March, without calling for their defence.
Magistrate Nur Azura Murah made the decision after finding that the prosecution had failed to prove a prima facie case against Nadzim, 54, and Tengku Faedzah Raja Fuad, 32.
Nadzim and Tengku Faedzah were accused of causing hurt to Adam Mikail, 43, at Level 3, Villa Puteri Condominium, Jalan Tun Ismail here at around noon on March 28.
In her judgement, Nur Azura said the victim's testimony was not supported by any document, while the footage from the closed circuit television camera was rather unclear and blurry, hence failed to prove that the victim was hurt by Nadzim or Tengku Faedzah.
The court was also satisfied with the testimonies of a medical officer and bone expert who opined that the leg injury, which the victim claimed to be caused by Nadzim, was an old injury and that the intense back pain, which he claimed to be caused by Tengku Faedzah, was actually due to bone degeneration due to aging.
Deputy public prosecutor S. Ravindran prosecuted, while Nadzim and Tengku Faedzah were represented by lawyer Ahmad Zaidi Zainal.
